Partisanship on both sides of the aisle have blinded Americans to the very dangerous and un-American nature of the Unitary Executive Theory. As long as “our guy is in charge,” an increasingly passive and accepting American public tells themselves … lulling themselves to sleep in the illusory “safety” of “their” American Führer’s embrace.
Couple of thoughts: Posner has placed his imprimatur of approval on the primary bete noir of the Framers: direct majoritarian rule, or the tyranny of the mob – as expressed by their choice of Fuhrer.
And the will of the mob is always primarily motivated by either fear or greed, (or both) which without fail ends up as the willing trade of liberty for security (and other peoples’ stuff). The Framers foresaw this, as well.
But just because you can see the train coming down the tracks at you doesn’t mean you can keep from getting your ass run over.
