Bachmann attempted to defend the lawsuit by hitting the GOP’s talking points, Cavuto wasn’t having any of it: Where was your rage with Democrats when Democrats were going after President Bush on the same use of executive orders? Because I think you knew then that was a waste of time then. I think you know in your heart of hearts this is a waste of time now.”

Eventually it devolved to the point where Cavuto abruptly took the program to a commercial break as Bachmann was in the middle of a loud denunciation of Cavuto.

When he returned, he apologized to Bachmann for accidentally cutting her off. “But I don’t apologize for my sentiment for the fact that we are wasting time filing lawsuits against one another,” he added. “These types of charades — and I’m sorry, that’s what I call them — are just that, charades.”

I’ve always liked Cavuto, and this exchange does nothing to diminish my affection for him.  He points out the futility and hypocricy of this bit of political kabuki.  This afternoon Mark Levin, who knows a little something about con law, stated that the Republicans alone did not have standing to file such a suit, and even if they did, it wouldn’t be decided until Obama was long out of office (something I also pointed out).

Of course, the entire history of the GOP House since 2010 has been the appearance of action without actually, you know, doing anything.
